The Court did not resolve the claims in favor of Plaintiffs or Defendants. Instead, both sides agreed to a settlement.  Through a settlement, both sides avoid the risks and cost of a trial, and the people affected will more quickly receive compensation.  The Lead Plaintiff and Lead Counsel recommend the settlement to all Class Members.

The Settlement results in a payment of $18,500,000, plus accrued interest less attorneys’ fees and expenses, for the benefit of Class Members.

On February 9, 2010 the Court approved, among other things, the administrative recommendations regarding the acceptance and rejection of claims and authorized the distribution of the Net Settlement Funds as set forth in the Plan of Allocation to those Authorized Claimants who would receive at least $5.00.  The distribution of the Net Settlement Funds took place on April 7, 2010.
