The Court did not finally resolve all the claims in favor of Plaintiffs or Defendants. Instead, both sides agreed to a settlement. Through a settlement, both sides avoid the risks and cost of a trial, and the people affected will more quickly receive compensation. The Lead Plaintiff and Lead Counsel recommend settlement to all Class Members.
The Settlement results in a payment of $18,500,000, plus accrued interest less attorneys’ fees and expenses, for the benefit of Class Members.
The Court will hold a Fairness Hearing on September 26, 2008. At the Fairness Hearing, the Court will determine whether the Settlement is fair, reasonable and adequate, and should be finally approved by the Court. In addition, the Court will consider whether to approve the Plan of Allocation, whether to approve an award of attorney’s fees and expenses, and other such matters as the Court may deem appropriate.
